KBXX-FM, SHABANA MOTORS $10K AND A FUNJET GETAWAY
NO PURCHASE NECESSARY TO ENTER OR WIN.
CONTEST DESCRIPTION:
The Shabana Motors $10K and a Funjet Getaway (“Contest”) will begin on Tuesday, May 31, 2011 at 6:00am CST and end on Thursday, June 30, 2011 at 11:59pm CST (“Contest Period”). The odds of winning depend on the number of eligible entries received from on-air contesting and retail registration.
Listeners of KBXX-FM who are twenty-one (21) years of age or older (at the time of Contest entry) and are legal residents of the United States who physically reside in the Houston / Galveston metropolitan area will have the opportunity to participate in the Contest for a chance to win one (1) cash prize amount of $10,000 in the form of a check and one (1) trip for the Grand Prize winner and a guest to Cancun, Mexico. The Grand Prize consists of roundtrip coach air transportation for the Grand Prize winner and a guest between Houston, Texas and Cancun, Mexico (air travel must originate from a Houston area airport); and five (5) nights double occupancy hotel accommodations in one (1) room at the all-inclusive Beach Palace Cancun, Cancun, Mexico. The Grand Prize drawing will be held on Friday, July 1, 2011.
HOW TO ENTER / EXECUTION:
Listeners of KBXX-FM who are legal residents of the U.S., and are twenty-one (21) years of age and older will be able to take part in this Contest. During the Contest Period there will be two (2) ways for listeners to enter, listeners must do one of the following to participate in the Contest.
1) Retail Registration: Beginning Tuesday, May 31, 2011 at 10:00am CST and ending Wednesday, June 29, 2011 at 9:00pm CST, eligible participants will be given the opportunity to complete an Official Entry form available at Shabana Motors located at 9811 Southwest Freeway, Houston, Texas 77074, (while supplies last) or entrants can hand print their complete name, street address (no P.O. Boxes) city, state, ZIP code, day and alternate phone numbers on a 3” x 5” piece of paper. (If you do not have a telephone, indicate “No Phone”. Failure to comply with this or any of the official rules will result in disqualification. Each entrant must confirm that he/she is twenty-one (21) years of age or older, either by checking the box on the Official Entry form or writing the words “I confirm that I am 21 years of age or older” on the 3” x 5” piece of paper. Deposit the entry in the entry box available at the location among all eligible entries to be entered into the Grand Prize drawing. Limit one (1) entry per person. No mechanically reproduced entries will be permitted. Illegible or incomplete entries are void. KBXX-FM station management, Shabana Motors, Inc., and Funjet Vacations (“Sponsors”) are not responsible for lost, late, damaged mutilated, misdirected entries or entries not received by the entry deadline. All completed retail entry forms must be received by 9:00 p.m. CST on Wednesday, June 29, 2011 to be eligible for entry into the Grand Prize drawing for a chance to win.
2) On-Air Contesting: Beginning Tuesday, May 31, 2011 at 6:00am CST and ending Thursday, June 30, 2011 at 11:59pm CST, listeners will be encouraged to listen to 97.9 The Box, Monday through Friday between the hours of 6:00am and 11:59pm CST at various times for the Shabana Motors $10K and a Funjet Getaway song scramble. The song scramble will consist of 2-3 seconds of five (5) specific songs played on KBXX-FM. When the song scramble is played, participants must call and be the 9th caller on the KBXX-FM request lines at 713-390-5979. Participants must correctly identify all five (5) songs featured in the song scramble by song title and artist name in the correct order as featured in the song scramble to be deemed as a Contest winner and will be offered the designated qualifying prize (qualifying Contest prize varies throughout the Contest Period) and entered into the Grand Prize drawing for a chance to win.
WARNING: Online listeners to streamed broadcasts may experience a lag in transmissions due to buffering limitations. Contest participants should not rely on streamed broadcasts.
On Friday, July 1, 2011, KBXX-FM will select one (1) potential Grand Prize winner at random from all eligible entries received through on-air contesting and retail registration participation.
All decisions made by KBXX-FM station management regarding any aspect of the Contest are final.
ELIGIBILITY RESTRICTIONS:
The Contest is open to listeners of KBXX-FM who are twenty-one (21) years of age and older and are legal residents of the United States.
Employees of KBXX-FM, Radio One of Texas II, LLC; Shabana Motors Inc., and Funjet Vacations (“Sponsors”), their respective parent companies, subsidiaries, affiliates, advertisers, promotional partners, other radio stations in the Houston / Galveston metropolitan area, and members of the immediate families or households of any of the above are NOT eligible to participate or win in this Contest.
Once an individual wins a prize in this Contest, they are not eligible to win another prize in this Contest except as specified within these rules.
Persons who have won a prize in another Contest or promotion of any kind from KBXX-FM within the thirty-day (30) period immediately preceding the start date of this Contest are not eligible to participate or win.
Travel guest of Grand Prize winner must also be twenty-one (21) years of age or older and a legal resident of the U.S. Winner and guest must possess required travel documents (e.g. valid photo I.D.) prior to departure and must travel on the same itinerary. Travel guest will be required to sign and submit all requested release forms along with the Grand Prize winner.
Contestants agree to abide with any applicable federal, state, local laws and regulations.
PRIZES & APPROXIMATE RETAIL VALUES (“ARV”):
ARV: $12,800. Actual retail value of trip may vary and will depend on airfare fluctuations and winner’s point of departure/return. Any difference between stated approximate retail value and actual value of prize will not be awarded.
QUALIFYING PRIZE:
All eligible on-air Contest participants who correctly identify all five (5) songs featured in the song scramble by song title and artist name in the correct order as featured in the song scramble will be deemed as a Contest winner for the qualifying prize. All Contest winners will be offered the designated qualifying prize (Contest prize varies throughout the Contest Period) and entered into the Grand Prize drawing for a chance to win the $10,000 cash prize and Funjet vacation to be given away on Friday, July 1, 2011.
DRAWING:
The potential Grand Prize winner will be selected in a random drawing held on July 1, 2011 by KBXX-FM promotions staff from among all eligible entries received through on-air contesting and retail registrations. Decisions made by Station management are final and binding. Odds of winning depend on the number of eligible entries received during the Contest Period. The potential winner will be notified by phone and/or email and will be provided with instructions on how to claim his or her prize. The potential winner and guest will be required to execute and return an affidavit of eligibility, a liability release, and where lawful a publicity release within seven (7) days of the winning notification date. If such documents are not returned within the specified time period, prize or prize notification is returned as undeliverable, if Sponsors are unable to contact a potential winner within a reasonable time period or potential winner is not in compliance with these rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner will be selected if time permits.
GRAND PRIZE – ONE (1) PRIZE WILL BE OFFERED: Consisting of roundtrip coach air transportation for winner and a guest between Houston, Texas and Cancun, Mexico (air travel must originate from a Houston area airport); and five (5) nights double occupancy hotel accommodations in (1) one room at the all-inclusive Beach Palace Cancun in Cancun, Mexico, and a cash prize of Ten Thousand Dollars ($10,000) in the form of a check.
Valid Travel Dates for Funjet Vacation are July 1, 2011 through August 15, 2012 and is based upon availability and published charter schedule departing from the Houston market. Blackout dates will apply. Vacations are nonrefundable. All travel is based on availability. Winner and a guest will need a valid Passport for travel to Mexico. If Passport is not in hand by time of travel, there will be no refunds nor extensions. Winners are responsible for any charges incurred for winner name changes or trip cancellations. Trips are nontransferable and are not redeemable for cash. Should either the hotel or destination be dropped from the Funjet Vacations product line prior to booking, Radio One of Texas II, LLC and Funjet Vacations shall have the right to substitute a comparable hotel or destination.
Prizes that are not mailed (via us mail or UPS) or provided by the participating sponsor must be claimed at the station’s offices within thirty (30) days of the date of winning.
No substitution of prize is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value, except as determined by station management and/or the Sponsor in its sole discretion.
All Contest winners must sign and date official station release and waiver forms as requested. Failure to do so will result in winner forfeiting the prize.
If for any reason a Contest winner provides notice that they have decided not to accept an awarded prize, the winner will be required to sign a release form acknowledging that they are forfeiting the prize. It will be at the discretion of the Contest Sponsor and / or Contest administrator if another contestant is to be selected as the winner if time permits.
All prizes (i.e. tickets, checks, gift cards) awarded to Contest winners must be picked up at the KBXX offices located at 24 Greenway Plaza, Suite 900 Houston, Texas 77046. Proper government issued identification and proof of age (i.e. via driver’s license, passport other photo I.D. with birth date) must be presented before prizes will be released to winners.
Ground transportation, meals, taxes, gratuities, luggage fees, passport fees, alcoholic beverages, sightseeing tours (or other excursions), souvenirs and incidentals are not included as part of the Grand Prize package and are the responsibility of the Grand Prize Winner and his or her guest.
KBXX-FM, Radio One of Texas II, LLC reserve the right to substitute prize merchandise (or prize element) with one of comparable or greater value.
Prizes that are within the Station’s possession after the pick up deadline are recycled for future on-air use.
Contest participants are subject to a limit of one (1) winner per household within any thirty (30) day period.
Prize winners are responsible for payment of any and all local, state, and federal taxes applicable to the prizes awarded.
GENERAL CONDITIONS:
Winners are responsible for all applicable taxes associated with the receipt of the prize (prizes are not transferable and may not be exchanged).
Winners of prizes that total $600 or more in value during any one calendar year are responsible for any and all state, local, and federal taxes based on the retail value of the prizes; and will receive a Form 1099 from KBXX-FM / Radio One of Texas II, LLC for the total amount of winnings; and a copy of such form will be filed with the IRS as required by law.
No purchase necessary. Contest is void where prohibited. Contest is subject to all applicable federal, state and local laws and regulations.
Odds of winning depend upon the number of eligible Contest entrants participating during the Contest Period.
By accepting the prize, the winner acknowledges that KBXX-FM and Radio One of Texas II, LLC have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or to any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.
By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest, in any media now known or hereafter devised for advertising or promotional purposes without additional compensation, and must sign a publicity release prior to acceptance of the prize. By entering this Contest, each participant agrees to comply with the Official Rules and the decisions of the Contest Sponsor which shall be final and binding in all aspects relating to the Contest.
Prize is not transferable. No prize substitution or cash equivalent of prize except at Sponsor’s sole discretion due to prize unavailability for any reason and only then for a prize of comparable value.
All Contest winners will be required to sign a liability release prior to acceptance of any prize. Pursuant to the liability release, the winner or winners will agree to hold KBXX-FM, Radio One of Texas II, LLC; any other Contest parties and each of their respective affiliates, subsidiaries, agencies, officers, shareholders, directors, employees, agents and representatives of each of the foregoing, harmless against any and all claims or liability, directly or indirectly related to or arising from or in connection with Contest participation or the acceptance, possession or use / misuse of awarded prize or any portion thereof, or participation in prize-related activities, including but not limited to any related travel.
If for any reason a Contest winner provides notice that he or she has decided not to accept an awarded prize, the winner will be required to sign a release form acknowledging that they are forfeiting the prize. It will be at the discretion of the Contest Sponsor if another participant is to be selected as the winner if time permits.
Winners must provide valid identification (i.e. via driver’s license, passport or other photo I.D.) to claim their prize.
The station retains the right to disqualify any entrant if all Contest rules are not followed. Contest void if prohibited by law.
So long as no participant is materially adversely affected, the station reserves the right to make changes in the Contest rules, which will become effective upon being announced on the air and / or posted online.
KBXX-FM, Radio One of Texas II, LLC; participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for the inability of any entrant to complete or continue a telephone call, facsimile transmission, text message, or internet registration due to equipment malfunction, busy lines, inadvertent disconnections, unavailable network, server, Internet Service Provider (ISP) or other connections, communication failures or human error that may occur in the transmission, receipt or processing of entries. In addition, KBXX-FM, Radio One of Texas II, LLC; participating Sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for lost, misdirected, mutilated, illegible or incomplete entries. Once submitted, entries become the property of the station and will not be returned.
By accepting the prize, the winner acknowledges that KBXX-FM and Radio One of Texas II, LLC; have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or to any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.
KBXX-FM, Radio One of Texas II, LLC; its subsidiaries, its affiliates, participating Sponsors and promotional partners will not assume any responsibility for any changes in the execution of the Contest, including; cancellation of the Contest as a result of the occurrence of events not within the control of KBXX-FM, Radio One of Texas II, LLC; its subsidiaries, affiliates, participating Sponsors, promotional partners and other radio stations, such as acts of God, strikes, terrorists acts or criminal acts of third parties. In the event, such an act should occur; reasonable attempts will be made to offer the winner comparable prize(s) currently being offered by the station in lieu of the prize originally awarded.
If for any reason, the Contest is not capable of running as planned, including without limitation, any suspected evidence of tampering or technological corruption or if any portion of the promotion is compromised by virus, bugs, worms or unauthorized human intervention, fraud, an insufficient number of qualified Contest entries, or any other causes beyond KBXX-FM and Radio One of Texas II, LLC’s control which, in KBXX-FM and Radio One of Texas II, LLC’s sole opinion, corrupts, threatens or impairs the administration, security, fairness, integrity, or proper conduct of the Contest, KBXX-FM and Radio One of Texas II, LLC reserve the right to cancel, terminate, modify or suspend the Contest at their sole discretion.
Any attempt by an entrant to deliberately undermine the legitimate operation of the Contest may be in violation of criminal and civil laws and should such an attempt be made, KBXX-FM and Radio One of Texas II, LLC reserve the right to seek remedies and damages (including attorney’s fees) from any such entrant to the fullest extent of the law, including criminal prosecution.
